Prior approval required for sharing and reporting of POSH cases: Bombay HC

In a hearing of case relating to Sexual Harassment at Workplace, the Bombay High Court has issued guidelines for matters of POSH cases. It has held that the media shall be barred from reporting any case heard under the Sexual Harassment of Women at the Workplace (Prevention, Prohibition and Redressal) Act, 2013 and would further require prior permission from the Court in order share the same.

It further held that such matters are to heard in the judge’s chamber or through in-camera method. Such orders would also be passed in open court and must not be uploaded on the official website.

The Bench headed by Justice Gautam Patel has directed for the anonymity of the parties to be maintained and any breach of the guidelines would amount to Contempt of Court. The Court in its guideline has provided the format of order and manner of proceedings and filings.

The Court observed that the protection of identity is crucial for both the sides. There were no such guidelines on this matter and thus these guidelines are only the first steps towards the interest of parties involved. The guidelines may be subjected to revision and modification as required.
