SC orders transfer of trial from Lucknow to Prayagraj in Kamlesh Tiwari Murder Case

Kamlesh Tiwari, a Hindu Samaj Party leader was murdered in Lucknow in October 2019.
In December 2020, the Uttar Pradesh police had filed a charge sheet against 13 accused persons in the case.

A plea was moved by Ashfaq Husen and nine other accused persons in the matter. The plea claimed that due to the communal atmosphere in Lucknow, they are facing prejudice.

The petitioners stated that they would be risking their lives if the trial is conducted in Lucknow district, as they have already received threats to life through local lawyers.

It was also stated that several accused are not being able to represent themselves in a just and proper way before the trial court owing to the backlash faced by them.

The petitioners believed that it would be in the interest of justice, only if the case is transferred from Lucknow to a neutral place.

A Bench of the Supreme Court consisting of Justice Sanjay Kishan Kaul heard the petition.

Keeping in mind all the points raised by the petitioners, the Supreme Court has ordered the transfer of the trial from Lucknow to Prayagraj.
