In the case of Siddaraju Vs State of Karnataka

A bench was hearing the application of the centre which seeks clarifications on Supreme Court verdict that related to the right to reservation in promotions for a disabled person.

Additional Solicitor General Madhavi who appeared for the centre argued that reservation for PwD with disabilities will lead to several practical problems.

As said in the Rajeev Kumar Gupta case that PwD reservation is not be prohibited. Whether it saying that Pwd reservation will apply in all promotions. The judgment needs clarification and it is also not understandable.

The judgment in the Siddaraju case was rendered in the context of the PwD Act 1995. The act was replaced with the Rights of Persons with Disabilities Act 2016.

Here are the clarifications necessary for the Siddaraju case. Because reservation provides in 2016 act are 4% and 1995 act provide 3% reservation.
