A husband who has sexual intercourse or any sexual act with a legally married wife, even if it is forced or against her will, will not rape: Chhattisgarh HC

The Chhattisgarh High Court has released a man of the offense of conjugal assault subsequent to seeing that sex or any sexual demonstration by a spouse with his lawfully married wife isn’t assault regardless of whether it was forcibly or against her desire.

A criminal modification was liked against a Sessions Court request which had outlined charges under 498-A, 34, 376 and 377 against the spouse and sec. 498A against parents in law on a grievance was enlisted by the spouse.

Explicit claims against the spouse were that he had made unnatural actual connection with her by embeddings fingers and radish in her vagina, regardless of her dissent.

Although the accusation was made against her husband according to sec. 377. The court relied on the Guahati High Court’s decision in Momina Begum v. Union of India, which stated that if the offender’s main intention was to obtain sexual satisfaction in an unnatural way, the offender’s behavior would attract crime.

The Court granted the revision petition in part, and discharged the husband under section 376 of the IPC while upholding the accusations under sections 377, 498A, and 34 of the IPC.
