On Monday the Bombay High Court has stayed the investigation in the matter of an FIR filed in which Karad Urban Co-operative Bank (KUCB) has claimed to be defamed with the web series ‘Scam 1992: The Harshad Mehta story’. The FIR was registered on 4th July, 2021.
The bank has alleged that in one of the episodes of the series, there is a bank logo in the background of a scene which seems similar to its trademark and has thus caused damage to the reputation of the bank. The FIR was registered under section 500 of the IPC, sections 102, 107 of the Trademarks Act and Sections 66C and 43(b) of the IT Act.
The bench headed by Justices SS Shinde and NJ Jamadar has ordered for grant of ad-interim relief until 17th September, 2021 to the quashing petitions of Sony Pictures Network India Pvt Ltd and producer Applause Entertainment Pvt Ltd.
In their petition, the petitioners had sought for stay of the investigation. The court has observed that there is no point in continuing the proceedings unless the investigation process is not proper.
