On Wednesday, the Apex Court issued notice to the Krishna Institute of Medical Sciences Limited upon filing of plea by a wife seeking 1 crore fund from the PM Cares and State CM relief funds for the transplant of her husband’s lung. It is contended that the petitioner has exhausted all her savings in the post covid treatment and seeks to receive financial assistance from the government.
The Bench headed by Justices LN Rao and Aniruddha Bose thus issued an order of notice that is to be served to the institute. The division bench informed the petitioner that although there is nothing much that could be done in the present case, the court has still issued a notice on August 6th 2021.
The petitioner argues that the plea is valid and must be upheld as per the principles of justice, equity and good conscience. Further, it is said that the petitioner expects the government to provide help in times of financial distress caused due to the pandemic. Not providing relief in times of distress is violative of Article 14 and 21 and the same would be considered as inaction on the part of the State to save a person’s life.
Further, the petitioner provides that she herself went to the PMO with her application seeking relief but her application was rejected at the counter saying a recommendation from the MP of the constituency was a prerequisite to for the application to be accepted.
The matter will be heard next on 13th August 2021.
