Rape survivor’s plea rejected by SC to marry rapist Catholic Priest

The survivor’s plea was that the convict (Catholic Priest Robin Vadakkumcherry) should be granted bail so that she can marry him in order to grant legitimacy to the child born to her after she was raped.

A Bench of Justices Vineet Saran and Dinesh Maheshwari said that it saw no reason to disturb the High Court’s order rejecting bail for the convict. The petitioner asked to approach the High Court for relief.

Catholic priest Robin Vadakkumchery, was sentenced to 20 years imprisonment under POCSO for raping and impregnating her while she was a minor on February last year.

Advocate Kiran Suri who appeared for the survivor said that she sought to marry Robin “to give legitimacy to the child.”

Advocate Amit George, who appeared for Robin, asked the court how his fundamental right to marry can be hindered in a bail plea.

The SC bench then said that they should approach the High Court. Adv Amit argued that the observations made by the High Court were very grim. To this the Supreme Court said, “You have invited it yourself.”

“We can only request the High Court to hear the accused. Approach the High Court for relief,” the Court added.
