Undertrial Prisoner Allegedly Killed By Jail Officers In Tihar Jail: Delhi court Transfers Probe To CBI

The Delhi High court on Tuesday transferred to CBI the investigation into alleged killing of undertrial prisoner by jail officers within the Tihar Jail, when perceptive that an in depth investigation into the matter is needed to be conducted.

Justice Mukta Gupta took note of the actual fact that there was no investigation into the claim by deceased’s sister that he had made a decision to her on a daily basis before his death expressing apprehension that he would be killed.

The petition was moved by mother of the deceased seeking CBI investigation and conjointly preservation of CCTV footages of the relevant time of death.

As per the report submitted on behalf of Jail Superintendent, it had been declared that four undertrial Prisoners were beating the deceased with a bat , as a results of that one in every of the inmates and deceased sustained injuries. The deceased was thenceforth taken to the jail clinic and was refered Safdarjung Hospital for treatment whereby he was declared as dead.

It was the case of the petitioner that by looking at the photos and videos of the deceased body, it would be seen that deep cut wounds on his thighs and hands couldn’t are caused by bat injuries and solely could’ve inflicted from some sharp object.

On the side of CCTV footages, it had been submitted on behalf of Director General of Prions that previous CCTVs put in within Tihar Jail had become non-functional and therefore, a mega set up of installation of the CCTVs is presently afoot which that they had been put in at the most of the places.

It was conjointly submitted that out of 6967 CCTVs to be put in, quite half the CCTVs put in were purposeful and rest would be created purposeful by 15th August 2021.

While directive transfer of investigation to CBI, the Court wanted a standing report back to be filed before resultant date of hearing.

The matter will be heard on Sep. 29.2021.
