Lieutenant Colonel Prasad Purohit, associate defendant among the 2008 Malegaon blast case, has sought-after directions from the BOMBAY HC for the court to re-adjudicate his discharge application on the purpose of absence of sanction underneath section 197(2) of the CrPC.
He prayed that the trial court’s findings to decide issue of sanction throughout the trial be overpassed and so the need of sanction underneath 197(2) of CrPC to prosecute him be re-decided in the light of fresh documents he claims to possess received from the military(army) .
He also claims that he attended conspiracy conferences before the 2008 Malegaon blast whereas “discharging his duties” as a military agent, thus sanction underneath section 197(2)of the CrPC is required to prosecute him.
On Thursday, a division bench of Justices SS Shinde and NJ Jamadar agreed to hear Purohit’s amended appeal seeking to remand the matter back to the court and adjourned the hearing for July 19.

In response to the court’s question if the NIA would be opposing Purohit’s prayers, Advocate Sandesh Patil aforementioned that if Purohit would withdraw his discharge plea before the supreme court with liberty to approach the special NIA Court, then the agency wouldn’t object.However, if he’s seeking directions to line aside specific observations of the judge, then the petition would have to be compelled to be detected at length.

Purohit claims to own received a response letter from the board of directors General of Military Intelligence in 2018. within the letter, supported 2 military reports from 2008 the DG has opined that Purohit had received some intelligence input through a “source network” and “Purohit’s superiors at applicable level were conversant of the inputs” given by the supply.
Baground – The Blast
On September 29 , 2008, the blast was caused by associate explosive fitted to associate LML Freedom Motor Cycle. Investigations among the case pointed to alleged Hindu extremists based in Indore. 12 individuals were arrested.
