Case – Mookan @ Murugan v. State
The Madras court recently expressed its anguish over the increasing instances of cases where children are sexually mistreated by persons known to them, despite rigorous laws.
The Court observations whereas confirming the conviction and sentence awarded to man for raping his 11-year-old relative.

Considering the “most deplorable and disgraceful conduct” of the suspect throughout this case, the court proceeded to verify the 10-year rigorous imprisonment sentence awarded to him by a Pudukottai court .
The appellant, in this case, had been condemned underneath Section 376(2)(f) of the IPC (rape of below 12 yrs aged . ) in 2016.
The trial court’s conviction of the appellant in the matter was challenged before the court . Dismissing it, the Court found that the regulatory offense stood well-tried by medical proof.
Whereas the grievance throughout this case was lodged concerning 7 hours once the incident occurred, the Court acknowledged that the delay in lodging an FIR is by itself does not raise an abstract thought that the grievance was false (Karnal Singh v. State of Madhya Pradesh) neither is it fatal to the prosecution’s case unless prejudice is caused to the suspect.
Justice Ravi Shankar additionally noted that the prosecution has punctually well-tried that the victim was 11 years aged at the time of the incident.
The Court proceeded to verify the appellant’s conviction and sentence among the matter.
