IT Rules 2021: J. Bhambhani divests him from addressing a challenge to the new legislation filed by Quint and The Wire

Justice Anup Jairam Bhambhani of the Delhi High Court exempted him from considering cases against the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“IT Rules, 2021”).

A holiday bench headed By justice Bhambhani and Jasmeet Singh requested that the case be heard by some other bench next Monday, which Justice Bhambhani is not a member of.

The Foundation for Independent Journalism, which publishes ‘The Wire,’ Quint Digital Media Limited, which publishes ‘The Quint,’ as well as other news organisations had filed the current challenges.

The applications claim that the challenged guidelines are a subterfuge to allow the government to access & control the content of online news sites directly. In light of the foregoing, the pleas ask for the IT Rules, 2021, to be declared unconstitutional and invalid for violating Articles 14, 19(1)(a), 19(1)(g), and 21 of the Constitution, as well as the Information Technology Act, 2000, inasmuch as they apply to “publishing houses of news and current affairs content.”

The issue will now be discussed on June 26.
