The Delhi High Court granted interim protection to digital website Newsclick and its founder Prabir Purkayastha, from coercive action w.r.t. a money laundering case and search and seizure activities carried out by the Directorate of Enforcement (ED) at his office and residence.
The court stated that no coercive action should be taken against Newclick and Purkayastha until July 5, 2021.
The proceedings of court started on Monday and went on till 11:30 PM on Tuesday.
Further the court issued notice to ED and ordered to give a copy of the ECIR and gave two weeks time to file its response.
Moreover the Delhi Police were asked to respond to another petition filed by Newsclick in order to reject the FIR initiated against it by the Economic Offences Wing.
The petitioner contended that while he had received a copy of the FIR but yet not received a copy of the ECIR from the ED.
The respondent argued that “ECIR is just a file number, not an FIR which is to be given to anyone.”
He also mentioned a 2005 amendment to the Prevention of Money Laundering Act (PMLA) in this regard to which court said same act is not effective as of now and ordered to provide ECIR copy.
Next the court will hear the matter on July 5th, 2021
