The Delhi Subordinate Services Selection Board (DSSSB) who is conducting the primary teachers recruitment exams were Prima facie intentionally insulting a specific castes by set up a caste based questions on question paper.
Today the Delhi high court upheld a trail court order and directed to file an FIR against unknown offenders under SC and ST (Prevention of Atrocities) Act, 1989.
The exams held on October 13, 2018 and August18, 2019 which questions being Prima facie insulting the specific castes.
The court said that, whether the DSSSB was aware of the contents of the question papers set or not, it can be ascertained only through investigation.
Question of invocation of Sec 197 of Crpc:-
The person who involved in the commission of the offense would be considered only after the stage of investigation is over.
By delivering the verdict, the vacation bench Justice Anu Malhotra dismissed the petition by the DSSSB challenging the order of the trail court which has directed to register an FIR against the offenders for the offences under the SC/ST Act.The court also refused to accept the contention of DSSSB.
