Plea in Supreme Court seeks ex-gratia monetary compensation

A plea in the Supreme Court, filed by Advocate Harisha SR, seeks an ex gratia monetary compensation to persons who have lost their families in the pandemic.

The petition stated that as per Section 12 of the Disaster Management Act, 2005, the National Authority shall recommend guidelines for providing minimum standards of relief to persons affected by disaster.

The relief which is available under this Act includes ex gratia assistance on account of loss of life. The petitioner has prayed for monetary compensation of ₹ 4 lakhs to be paid to the families on account of the loss of lives.

The petition further seeks directions for issuance of official documents stating the reason of death as such documents are required to get any assistance or medical compensation.

The petition also states that it is the legal obligation of the State to provide adequate relief to the victims of COVID-19 and their family members under State Disaster Response Fund (SDRF).

It further stated that it is the Constitutional obligation of the State to take care of the victims of the calamity and their families.
