The Madras High Court on Friday granted bail to a man accused of rape and cheating considering that the complainant and the accused expressed their readiness to marry each other.
On February 25, 2021, accused was arrested on the charges that sexually assaulted the complainant, got her pregnant and later refused to marry her.
Subsequently, mother of the victim girl registered an FIR against the accused for offences of Cheating under Section 417 and for punishment of Rape under section 376 of the Indian Penal Code (IPC).
It was reported to the court that the accused and the girl were ready to marry each other and that their parents have arranged for the marriage.
Moreover, Justice M Dhandapani proceeded to grant bail in the case, and observed that:-
“Taking into consideration the fact that … the petitioner is ready to marry the victim girl and also considering the period of incarceration suffered by the petitioner, this Court is inclined to grant bail to the petitioner…”
Bail was granted subject to the execution of a Rs 10,0000 bond and two sureties.
