Supreme Court heard an anticipatory bail case on Holi

Case – Jude Lobo v. NCT of Delhi

An FIR was lodged by a woman in December 2020, against Jude Lobo a restaurant-owner in Goa,for allegedly raping the woman in 2009.The Delhi High Court refused to grant relief to the restaurant owner.A Vacation Bench of the Supreme Court consisting of Justice Ashok Bhushan and Justice S Abdul Nazeer Bench heard the appeal on Holi, on an urgent basis in order to protect Jude Lobo from arrest.

Senior advocate Mukul Rohatgi, representing Mr.Lobo, stated that this is an example of a “cock and bull story” as these were vague allegations. In her statement under Section 164 of the Crpc, she stated that she met Lobo in 2009, and he had promised to marry her.It was further stated by the petitioner that these allegations were made against him as he prevented the woman from hosting a party, due to the COVID-19 restrictions.

The Bench was satisfied with the petitioners case and stated that this is a case of anticipatory bail. If he is arrested, he shall be released on a personal bond of ₹10,000.

The Court further ordered to issue a notice to implead the complainant as Respondent No 2.
