A lawyer from Mumbai, Ahamed Aasif Fakih, was held guilty by Thane court (Maharashtra) for attempting to murder his wife. For this, he is sentenced to ten years of rigorous imprisonment with a fine of Rs.5,00,000/-.
The Additional Sessions Judge observed that the assault on the prosecutrix was pre- planned which led to both physical and monetary loss to the prosecutrix and moreover the prosecutrix/complainant had proved beyond reasonable doubt she was being assaulted by Fakih.
The case was related to the complaint being lodged by the wife under section 498A on which the husband(Fakih) filed a case for the custody of the child. And out of all this, in anger, which prima facie appeared to be pre- planned, Fakih pointed a gun on his wife in the presence of Advocates of both the sides. But, with god’s grace, the trigger of the gun didn’t work.
He then gave a blow on his wife’s head and hand which caused him grave injuries.
The court pronounced the judgment ex-parte and held him guilty under section-307 and sentenced him to rigorous imprisonment. Though, he has the right to be heard for the quantum of sentence.
