The High Court of Allahabad has given clear directions to the Secretary of Basic Education Council Prayagraj to make a firm decision on the basis of medical grounds by two assistant teachers, considering the necessary requirement for mutual transfer without any formality.
The honourable high court asserted that wife of the Petitioner is suffering from serious disease- Cancer and he has asked for a transfer to his hometown to take care of his ailing wife with consent of one of the teachers. Hence, the decision over this matter must be taken without any futher delay. This order was passed by the Single bench of the honourable Justice S.D. Singh.
The plea was a joint Petition which was filed by the mutual consent of two assistant teachers of Shamli and Baghpat.
They wish to exchange their work places citing serious family issues. The wife of one of the Petitioner is suffering from cancer hence he wishes to shift back to his hometown.
The court while hearing the petition said that the prima facie decision has to be made by the respondents themselves, as the plea is pending before them.
But the honourable court directs the respondent to decide over the matter as soon as possible, so that nobody suffers.
