Ms. Aparna Purohit (Commercial Head of Amazon Prime) has filed a plea where she challenged the judgment of Allahabad High Court that denies the pre arrest bail to her in the criminal case registered due to the web series ‘Tandav’ Thus, the new rules framed by the Central Government to regulate the OTT platform under the Information Technology Act has been dissatisfied by the Supreme Court.
To which, the Supreme Court referred to the Information Technology (Guidelines for Intermediaries and Digital Media Ethics Code) Rules, 2021 and stated that the rules framed by the Central Government lacks enforcement.
The rules framed lacks the provision for any kind of fine or prosecution to be imposed and are just normal guidelines without any legislation.
To which the Solicitor General has pleaded that the new rules brought the by the Central Governmemt is to maintain a balance between the Internet and no censorship.
