The Punjab & Haryana High Court rejected the plea of an IAS officer of Haryana cadre who is 100% impaired. The plea sought to challenge the Haryana government order of his transfer from the post of Deputy Commissioner, Fatehabad to the post of Director General, Swarna Jayanti Haryana Institute of Fiscal Management (SJHIFM).
The Court while dismissing the plea held that no employee has the right to stay posted at the place of his choice, it is totally as per the discretion of the employer that weather an employee to be transferred or not.
IAS officer, Ravi Prakash in his plea contended that he is 100% visually impaired and he was initially posted at Chattisharh and after than he was transferred to Kaithal for the post of DC, than to the post of DC, Fatehabad and now he is being transferred to the post of DG, SJHIFM.
He challenged his transfer at CAT but got no relief and therefore he moved P&H High Court where his petition is dismissed.
