In the case of Kamini Devi v. State of Uttar Pradesh, The Allahabad High Court held that Live in relationship between consenting adults is not a crime.
In this case the petitioner contested that since her family was trying to get her married without her consent, she decided to live separately and with petioner no. 2. They both mutually decided to live together and were adults.
Inspite of this, The family continued to harass them. And even when the Petitioner requested Police Protection, No action was taken on such complaint.
The High Court held the Following:
“It is settled law that where a boy and a girl are major and are living with their free will, then, nobody including their parents, has authority to interfere.
In case any disturbance is caused in the peaceful living of the petitioners, the petitioners shall approach the Senior Superintendent of Police, Farrukhabad i.e. the second respondent, with self attested computer generated copy of this order downloaded from the official website of High Court Allahabad, who shall provide immediate protection to the petitioner.”
