A plea was filed by Tej Bahadur, an ex-border Security Force Constable challenging the last year election of PM Narendra Modi in the Lok Sabha for the Varanasi Constituency. This plea was rejected by the three Judge bench.
Tej Bahadur filed a petition to set aside PM Modi elections in the Allahabad High Court. He wanted to contest against the PM and was a candidate of Samajwadi Party’s from Varanasi but was rejected by the Election Commission after the submission of documents. The returning officer rejected his nomination as he could not clarify about his dismissal. The High Court rejected his petition and held that he cannot question the election of PM Modi because he was not a candidate nor an elector of the constituency in question. He then approached the Supreme Court by challenging the High Court’s order.
