SC urges Delhi govt to move HC to reserve 80% ICU beds for COVID-19 patients.

The Supreme Court demanded on Tuesday that the AAP government bring an appeal to the Delhi Supreme Court against the staying of decision of reservation of 80% of ICU beds in 33 COVID 19 private hospitals. A bench consisting of Justice Ashok Bhushan and Justice B R Gavai took notice of the government of Delhi’s urgent plea on the grounds of a sudden increase in the national capital’s case of COVID-19, and said that its appeal should be heard in a High Court divisional bench on Thursday rather than on November 27.

On September 22, a single-judge court stayed the Delhi government’s decision on 12 September, stating that 33 large private hospitals would be in violation of the constitutional rights of those suffering from other health conditions if they reserve 80% of the ICU beds for COVID-19 patients.

In the face of a high court division bench, the Government had already challenged the single judge decision to hear it on November 27.
