IA filed for horizontal reservation instead of inclusion under OBC category for transgenders persons in Karnataka HC

An Interim Application (IA) was filed by a public charitable Trust  working for the welfare of transgender persons named Jeeva in the case (Sangama v. State of Karnataka) against non-inclusion of a separate category of transgenders persons for Police recruitment in Karnataka as the government notification for the same had only mentioned men and women.

During the hearing of the case before a bench of Chief Justices Abhay Shreenivas Oka and Justice Vishwajith Shetty, the state government had informed the court of its intention to include reservation for transgenders persons under the Other Backward Class (OBC) category. The IA was filed against the OBC reservation and instead sought for horizontal reservation for gender identity like that of women.

Inclusion under the vertical OBC category would deny transgenders persons from the Backward Classes to seek both horizontal and vertical reservation. The reservation was sought in public employment, public education, allotment of housing sites and schemes
