A three judge bench of Chief Justices SA Bobde, A S Bopanna and V S Subramaniam has ordered telecom companies Airtel and Vodafone to disclose details on their offers to the Telecom Regulatory Authority of India (TRAI) while hearing an appeal against an order passed by the Telecom Disputes Settlement and AppellateTribunal. The information shall be kept discreet and shall not be disclosed to fellow competitors.
The appeal was filed by the regulator against the order stating that promotional offers given to customers who are likely to switch their providers were not tariff plans. Tariff plans are to be applicable in a discriminatory manner and to ensure transparency the same are to be disclosed to the regulatory authority under the Telecom Regulatory Authority of India Act, 1997.
The respondents had earlier informed the court of their readiness to furnish information in case of any complaint received, which was not the case at hand. However, the regulator has the jurisdiction to seek the fulfillment of Reporting Requirements.
