Bombay High Court has granted anticipatory bail to the accused under Section 354 of IPC

Justice Sarang V Kotwal while hearing an anticipatory bail application filed by one Raviraj Gupta observed that the case was solely dependent on the side of the victim and if futher it was proved that allegations were false then it will have an irreparable loss if the accused was arrested.

The FIR was lodged by the victim herself on September 26, 2020. She joined M/s. RR Associates since September 18, 2020. On September 25, 2020, applicant on account of discussing some office work with complainant touched her inappropriately while she was sitting on the chair. Further, again the applicant came near her and again touched her inappropriately. Lady lodged complain under Section 354 of IPC.

Section 354 of IPC deals with “outrraging the modesty of the women”. The Court further held that though the offence would definitely fall under the offence of sexual harassment (Section 354A), it is slightly doubtful as to whether it would fall U/s.354 of the IPC.

Further anticipatory bail has been granted by the Court to the applicant.
