
A bench of justice Suresh Kait while hearing the petition of Tahir Husain’s alleged associate Irshad Ahmed in Delhi riots case granted him the bail after observing that “the said witnesses seemed to be planted one.”
The petitioner filed the case under section 439 of CrPC for granting him bail in case FIR no. 80 of (2020). he was accused of offences under Sections 147/148/149/436/427/34 IPC and Sections 3/4 PDPP Act, registered at Police Station Dayalpur, Delhi.
Earlier the name of Irshad Ahmed was disclosed by Kuwait used Tahir Hussain. Further the statement of eyewitness named Rohit, was recorded in identification of the petitioner.
further the court observed that “Charge-sheet has already been filed. Trial of the case shall take nsubstantial time. However, without commenting on the merits of the case, this Court is inclined to grant bail to the petitioner.” Therefore, the court granted him the bail against the personal bond security of rupees 25000.
