A bench of Justices L Nageshwara Rao, Hemant Gupta and S Ravindra Bhat heard submissions in the plea filed by the Madras Bar Association challenging the Tribunal Rules, 2020. The petition’s hearing in the Supreme Court took place through video conferencing on friday
The petitioners contend that the rules violate articles 14, 21 and 50 of the Constitution and also are contrary to the judgement of the Apex court passed in cases of Rojer Mathew and SP Sampat Kumar. Provisions of the rules such as the 4 year tenure period, ineligibility of advocates for some tribunals and eligibility of ILS members for president were challenged.
The court reserved its order and also extended the tenure of any retiring Chairperson, Vice Chairperson or members of the tribunal upto 31st December. Parties are allowed to submit written submissions.
