
A single bench of the Gauhati High Court comprising of Justice Achintya Malla Bujor Barua on wednesday ( October 7, 2020) directed the State Government of Assam to take positive steps to shift the foreign detention centres outside the jail premises.
The Court observed that in the jails of Goalpara, Kokrajhar and Silchar, foreign detention centres were maintained within the jail premises since past 10 years whereas in the jails like Jorhat, Dibrugarh and Tezpur, such centres were maintained within the jail premises since last 5 years.
Further in this regard Court observed that “From the aforesaid, it is discernible that the detention centres must be outside the jail premises and secondly pending any acquisition of lands and construction of buildings, the State Government may find suitable accommodations for the purpose and if government buildings are not available, the State Government may look for hiring private buildings for the purpose”
