A bench of Justice Rajiv Sharma and Harinder Singh Sidhu heard the case in video-conferencing. This order virtually modified another order that was passed 3 months which allowed all private schools to collect admission and tuition fees from students regardless of whether they were holding online classes or not. The schools were also allowed to recover “genuine expenditure” including “actual transport charges.” Both Punjab and Haryana governments challenged the decision passed by two separate single benches.
The High Court of Punjab and Haryana has ruled that Private schools can demand tuition fee from the students only if the online class takes place daily in the lockdown period. The Court also directed that:
- The school management has to submit files of balance sheets of the past 7 months verified by Chartered Accountant within 2 weeks.
- All teachers and other staff members are entitled to regular salaries from the time of imposition of lockdown.
- No transportation fees should be collected from students.
