Gauhati High Court takes up plea against NIA’s rejection of bail

The Gauhati high court has accepted an application of farmer leader Akhil Gogoi within which Gogoi has challenged the dismissal of bail by the NIA Special Court in a case registered in reference to the alleged role in violent demonstrations against the Amended Citizenship law in the state.

The division bench observed: this is basically a matter about bail and private liberty of the appellant, we are bound to give only 2 weeks’ time.”

This plea beneath section 21 (4) of the NIA Act, 2008 has been directed against the order of July thirteen, given by the Special Judge, National Investigation Agency.

Gogoi’s bail plea was rejected by the NIA Special Court on August seven. Gogoi, who heads the Krishak Mukti Sangram Samiti, was found infected with COVID-19 and is presently undergoing treatment at Gauhati Medical College and Hospital.

Gogoi was arrested on December twelve last year and was handed over to the NIA for his alleged role within the violent demonstration and his potential involvement with Maoist components.

The division bench has directed the NIA to present the record of the case on 13 October.
