DCW Chairperson Swati Maliwal Writes Letter to CJI Seeking HC Monitored Inquiry into Hathras Gang Rape Case

Swati Maliwal, the Chairperson of the Delhi Commission for Woman has urged CJI S.A Bobde to take cognizance Hathras gang rape case in which a 19 year old Dalit girl was raped by 4 men. The letter states that “every possible fundamental right of the victim was violated.”

Maliwal has also shown concern regarding the actions and investigation of the police and the Uttar Pradesh government in the said incident which occurred on 14th September 2020. It is being said that the police failed to register a case of gang rape or rape until 22 September 2020 and there was delay in shifting the victim to an appropriate medical facility in Delhi.

Maliwal has urged the Court to pass directions for:

1) A High Court monitored investigation and trial to ensure strictest and swiftest possible punishment to the accused in this crime.
2) Immediate suspension and punitive action against all erring police and administrative officials including the senior-most officials who tried to cover-up the incident.
3) Setting in place definite mechanisms to ensure that no other daughter has to suffer the same fate.

The victim was shifted to a hospital in Delhi on 28 September 2020 and succumbed to her injuries on 29 September 2020. The victim’s body was taken to her village but was not handed over to her family. The police cremated her body at 2:30 A.M (midnight) against the traditions and request of the family.
