The Allahabad court has accepted the plea for an interim bail for 2 months to former state minister Gayatri Prasad on medical grounds. Prajapati has been held and is on trial in reference to a rape case.
The order was passed by Justice Ved Prakash Vaish on the 2nd bail application filed by the Gayatri Prasad.
Granting bail, the court aforesaid the threat to the ex-minister from COVID-19 was real and imminent.
The applicant is convicted under Section 376(D), 354A(I), 504, 506, 509 of I.P.C. and Section 5 and 6 of POCSO Act, 2012.
The lawyers additionally submitted that Prajapati was affected by serious ailments of that no treatment was out there in jail hospital or KGMU. The lawyers demanded that Prajapati be discharged for a short period to avail of medical treatment. Opposing the plea, the authorities counsel aforesaid that Prajapati was being given adequate medical treatment.
While granting bail, the court imposed numerous conditions on him. The former minister has to surrender his passport and he cannot leave the country without the previous permission of the court. It conjointly directed him to not threaten the prosecutrix and her family and to not obligate prosecution witnesses.
The court directed him to furnish 2 sureties of Rs 2 lakh each and a private bond of Rs five lakh for his unleash.
