Jalandhar’s former Catholic bishop Franco Mulakkal has filed a petition in the Supreme Court seeking discharge within the nun rape case.
Franco has also sought Stay in the trial proceedings until the Supreme Court pronounces its order within the said plea.
Franco has submitted that he has been framed within the alleged rape case and allegations are made only to hunt personal revenge. He has further submitted that the complaint because he raised the questions on the financial dealings of the nun. Moreover, there are discrepancies within the statements given by the nun, Franco added.
Earlier the high court of Kerala had dismissed Franco’s plea seeking discharge within the rape case. The Court had also directed him to seem for trial, however, he didn’t do so pursuant to which the court canceled his bail order and issued a nonbailable warrant against him. Thereafter Francisco moved the Supreme Court.
Meanwhile, the nun and therefore the state government have also filed petitions opposing the said plea of Franco and have requested the Court to not eliminate the case without giving them a chance of being heard.
The Supreme Court is probably going to listen to all the petitions together next week.
Franco Mulakkal was arrested on September 21, 2018, due to rape allegations rape after a nun within the Missionaries of Jesus congregation filed a complaint accusing him of raping her 13 times between 2014 and 2016 in Kottayam.
