Delhi HC directed DG (Prisons) to conduct an Inquiry and Submit the Report Related to Cases of Unlawful Detention of Prisoners in Last 3 Years

A Writ has been filed by a Prisoner who was being unlawfully detained even after the bail has been granted to him by the honorable Court. In lieu with the Writ of Prisoner a division bench comprising Justice Hima Kohli and Justice Subramonium Prasad of Delhi High Court directed the Director General (Prison) to conduct a ground level inquiry and submit a report regarding instance in the last 3 years when prisoners were unlawfully/illegally detained for more than 24 hours even after being granted bail from the competent court.

In the ongoing case of ‘Sanjay Singh v. GNCTD’, the alleged granted bail under both the complaints registered against him under Section 138 of the Negotiable Instruments Act and all the formalities were also being completed by him in due time but unfortunately prison authorities didn’t release him and unlawfully detained him for almost 10 days from June 15 to June 25.

The court was extremely dissatisfied with the behavior and excuses of police authorities and further directed the DG (Prison) to conduct an inquiry and submit the report. Meanwhile, the Court has given August 6 as a further date for the hearing.
