Extension of Statutory Period in Delhi Riots Case?

Ishrat Jahan was arrested on 21st March (F.I.R. 59/2020)
Senior Counsel Rahul Mehra on behalf of the Delhi Government submitted during petition hearing of Ishrat Jahan which challenged the extension of the period to put an end to the investigation against her involvement in the Delhi Riots.

The Single Judge Bench of Justice Suresh Kumar Kait took up the case today.

Ishrat Jahan stated that there were no reasons to extend the period of investigation and her advocate stated that all investigation was already complete.

It was argued on behalf of the Delhi Police that under Section 43D of the Unlawful Assembly Prevention Act extension of period is granted.

Rahul Mehra also noted that on 17th July a suo moto appointment of Special Public Prosecutor by Lt. governor was set aside by the Deputy Chief Minister of Delhi.

The Court reserved its order after hearing the parties.
