Sreelekshmi S. vs. State of Kerala
WP(C).No.10867 OF 2020

A PIL for the cancellation of school fee was filed in the Kerela High Court, by two students, Sreelekshmi S. and Dhanvin M. Pillai of Sree Buddha Central School. It was contended by the students that the non payment of tuition fee should not result in denying the student the right to attend online/virtual classes amidst the lockdown.

The school responded stating that the teaching and non-teaching staff need to be paid and thus fee collection cannot be cancelled.
Chief Justice S. Manikumar and Justice Shaji P. Chaly hearing the case observed that the “maintenance expenditure is a factor to be considered” and rejected the plea. It was also noted that there has been no hike in the fee structure, making no grounds for cancellation.

The bench also stated that the court cannot direct the Government to mandate a uniform fee structure among CBSE schools. However, the court asked the school to consider requests of monthly payments, pleaded by the petitioners.
