No stay on HC decision to reinstate Mr. Ramesh Kumar as SEC, Andhra Pradesh

A division Bench consisting of Chief Justice of India SA Bobde, heard a Special Leave Petition which challenged the order of High Court of Andhra Pradesh. This order removed Retired Justice V. Kanagaraj as State Election Commissioner and asked to reinstate Mr.Ramesh Kumar, whose tenure was cut short due to his decision to postpone local body elections.

The YSR Congress Government had promulgated an Ordinance which stated that the SEC tenure to be brought down to three years from five years, amending the AP Panchayati Raj Act, 1994.

The High Court of Andhra Pradesh, struck down this Ordinance.
It also quashed the Government order which appointed Retired Justice V. Kanagaraj as the SEC. Such was declared on a batch of Writ Petitions that challenged the validity of the Ordinance and the appointment of a new SEC officer.

The Supreme Court of India refused to put a stay on the order and asked for responses from the SEC and Mr. Ramesh Kumar.
